Terms of Service

Welcome to Glossy ("we," "our," or "us"). By accessing or using the Glossy platform at weglossy.com (the "Service"), you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years of age and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Glossy is a platform that allows creators to sell digital products, including files, courses, subscriptions, and other digital content ("Products"). Buyers can discover and purchase Products from creators.

3. Creator Accounts

To sell on Glossy, you must create an account. You are responsible for:

• Keeping your account credentials secure
• All activity that occurs under your account
• Providing accurate account information
• Notifying us of any unauthorized access

4. Creator Responsibilities

As a creator, you represent and warrant that:

• You own or have the rights to all content you upload and sell
• Your Products do not infringe any third-party intellectual property rights
• Your Products comply with all applicable laws
• Your Products do not contain malicious code, viruses, or harmful content
• You will fulfill all purchases made through your storefront

We reserve the right to remove Products that violate these terms or our policies without notice.

5. Prohibited Content

You may not sell or distribute content that is illegal, harmful, deceptive, or that violates third-party rights. This includes but is not limited to: counterfeit goods, stolen content, malware, adult content involving minors, or content that promotes violence or discrimination.

6. Fees and Payments

Glossy charges a platform fee on each sale:

• Free tier: 8% platform fee per transaction
• Pro tier ($20/month): 2% platform fee per transaction

Stripe processing fees apply separately. Payments are processed by Stripe. By using our payment services, you also agree to Stripe's Terms of Service.

7. Refunds and Disputes

Creators set their own refund policies. Buyers should contact the creator directly for refund requests. Glossy may intervene in disputes at our discretion. We reserve the right to issue refunds on behalf of creators to protect buyers from fraud.

8. Intellectual Property

You retain all intellectual property rights in the Products you sell. By listing a Product on Glossy, you grant us a limited license to display and promote your content on our platform.

Glossy and its logo are trademarks of Glossy. You may not use our trademarks without our express written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOSSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE FEES PAID BY YOU IN THE PAST 12 MONTHS.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may close your account at any time from your account settings. Outstanding balances will be paid out according to our normal schedule.

12. Changes to Terms

We may update these Terms at any time. We'll notify you of material changes by email or via the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
